Terms of service
Effective October 13, 2026
These terms are an agreement between you and Tinker and Twist LLC, an Oregon limited liability company ("we", "us"), which operates Chirpybot. They apply to your use of this website and the cloud service your AI companion devices connect to (together, "the service"). By creating an account or using the service, you agree to them. Please also read our Privacy policy, which explains what data we collect and why.
1. Your account
- You must be at least 18 to create an account. You're responsible for how your companions are used in your home, including by children and guests.
- Give us a real email address you control, keep your sign-in methods secure, and tell us at privacy@chirpybot.com if you think someone else got into your account.
- You're responsible for the activity in your account and your homes, including people you invite.
2. Your AI service and key
- Your companions think using an AI service you choose, with an account and API key that are yours. We don't provide AI keys. Your use of that service is governed by your agreement with its provider, and any charges it makes are yours. We recommend setting a spending limit in its console.
- You authorize us to store your key encrypted and to use it only to run your companions and the features you use (such as answering, looking things up and checking the key works).
- You may remove or replace your key at any time; we destroy the removed key.
3. What companions say
Companions are AI: they can misunderstand, and they can be wrong. Facts about events, opening hours and the like are only stated when they could be confirmed on a web page, with the source named, but pages can be wrong or out of date. Don't rely on a companion for medical, legal, financial, safety or emergency matters. A companion can't call emergency services.
4. Acceptable use
Don't use the service to:
- break the law, or infringe anyone's rights or privacy (for example, recording or monitoring people without their consent where that's required);
- harass, threaten or harm anyone;
- attack, probe, overload or reverse engineer the service, or get around its limits or security (security researchers: please report issues to privacy@chirpybot.com, and we won't take action against good-faith research that respects people's data);
- access accounts, homes or devices that aren't yours;
- resell the service, or connect devices or software we haven't made available for it.
We apply fair-use limits (for example on lookups and conversation volume) to keep the service working for everyone.
5. Your content
What you say to your companions, and the notes they keep, belong to you. You give us only the permission needed to process them to provide the service, as described in the Privacy policy. We don't use your content to train AI models, and we don't sell it.
6. Devices and updates
Companions receive software updates from the service automatically, signed by us, to fix problems and improve them. Removing a companion from your account stops it using the service immediately.
7. Changes and availability
We work to keep the service running, but it's provided as it is and may sometimes be unavailable, for maintenance or reasons outside our control. Features may change. If we make changes to these terms that matter, we'll email account holders before they take effect; continuing to use the service afterwards means you accept them.
8. Ending
You can stop using the service at any time and ask us to delete your account. We may suspend or close accounts that break these terms or put the service or other people at risk; where reasonable we'll tell you first and explain why. If we ever shut the service down, we'll give account holders at least 30 days' notice.
9. Disclaimers and limits
To the extent the law allows, the service is provided "as is" without warranties of any kind, and we're not liable for indirect or consequential losses, or for charges from your AI provider. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us for the service in the 12 months before the claim, or US $50. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
10. Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be heard in the state or federal courts located in Oregon, and you and we consent to their jurisdiction. If you're a consumer living elsewhere, you keep any protections the laws of your home country or state give you that can't be waived.
